A Circuit Court judge on Friday struck down a complaint by Veolia Solid Waste alleging that a city of Evanston impact fee and other actions against the company’s waste transfer site were imposed illegally. Judge Lee Preston, in an order Friday, struck down the complaint, ruling it was too vague and failed to comport with state civil procedure code. He gave Veolia until June 1 to file an amended complaint. Gerald Callaghan, attorney for Veolia on the case, could not be reached late Tuesday for comment. Evanston police currently have two subjects in custody for possession of a firearm after investigators learned that a vehicle involved in a shots-fired call in Chicago’s Rogers Park neighborhood drove into Evanston via Sheridan Road at about 10:50 a.m. Friday. Evanston police found the vehicle in the area of Greenwood Street and Judson Avenue, but the occupants ran from police, said Cmdr. The city of Evanston is making the first moves in the eventual layout of more than $2 million to bring a long-sought-after Trader Joe’s grocery store to a vacant site at 1211 Chicago Ave., formerly a Blockbuster store. Evanston aldermen won’t adopt a staff recommendation and curb stinging citizen criticism by moving comments on non-agenda items to the end of their sometimes marathon meetings or to a separate meeting once a month. But they may avail themselves to a rule already on the books allowing them to respond if they feel criticism is out of bounds.
